The application is being licenced to you by Protocom Technology Pty Ltd ("Protocom") free of charge and is provided to you for your use only in accordance with these terms. Protocom may change or withdraw the application at any time, without notice. |

| Your obligations |
| 2.1 |
You must have an active Telstra pre-paid or post-paid mobile service to use the application. You are responsible for obtaining and maintaining the telecommunication services necessary to use this application. |
| 2.2 |
Your use of the application is subject to Protocom's Terms of Use, Licences and Notices ("TOU"), which can be found at http://www.protocomtech.com.au/pdf/protocom_TOU.pdf and the terms of your mobile service, which set out the charges you must pay for sending SMS messages and their privacy policy. |
| 2.3 |
It is very important that you:
| (a) |
ensure that your computer system meets all relevant technical specifications necessary to use the application and is compatible with the application; and |
| (b) |
implement sufficient procedures and virus checks (including anti-virus and other security checks). |

| 2.4 |
If there is any inconsistency between these terms and Protocom's TOU, Protocom's TOU will prevail. |
| 2.5 |
You must take all reasonable steps to ensure that the Username and Password used by you for the purpose of accessing this service is not disclosed to a third party or compromised in any way. |
| 2.6 |
You must not use this service to commit an offence or allow anybody else to do so. |

Protocom's warranties and liability

Protocom has used reasonable care and skill in providing this application to you. |
| 3.2 |
Protocom does not accept liability for losses that result from any use of the application in connection with the conduct of a business or events beyond Protocom's reasonable control. |
